Legal Responsibilities of Domain Name Leasees
Night Owl Publishing, Inc. may elect to accept or reject your offer to lease a domain name for any reason in its sole discretion. Domain Name lease will become effective upon approval by Night Owl Publishing, Inc. and run for the period of time paid for by Leasee. Domain Name Leasees acknowledge that use of the domains they are leasing from Night Owl Publishing, Inc. is subject to the following terms and conditions and that submission of your domain name lease application constitutes acceptance of all the terms and conditions contained and referenced herein.:
A. Renewal obligations. You are solely responsible for ensuring that any and all domain leases and additional services are renewed prior to their expiration, should you so desire their renewal. You may renew your domain lease at any time before the expiration date. Night Owl Publishing shall have no liability to you or any third party in connection with the renewal, including, but not limited to, any failure or errors in renewing the services.
Leasee may be notified at Night Owl Publishing's sole discretion when renewal fees are due. Should these fees go unpaid within the time specified in a notice or reminder regarding renewal, your lease will be cancelled. Payment must be made by such other method as we indicate in the renewal form. If your billing information is not accurate, you are solely responsible for the failure to renew.
B. Legal Requirements. Leasee agrees to abide by all federal, state, and local laws including Intellectual Property, Libel, and Campaign Finance Laws. Leasee assumes all responsibility for content placed on or disseminated from the domain names leased from Night Owl Publishing. Leasee further agrees to do nothing which would violate the Registration Agreement Night Owl Publishing has entered into with its registrar (NamesDirect), paying particular attention to the following articles:

C. Indemnification. Leasee agrees to indemnify, defend and hold Night Owl Publishing, Inc, its directors, officers, employees and agents harmless from and against any and all costs, liabilities, expenses, judgments, damages and other losses (including, without limitation, reasonable attorneys fees, costs, judgments, awards, settlement amounts and expenses with respect thereto) arising from any third party claim or action. Leasee will notify Night Owl Publishing, Inc. immediately upon becoming aware of any claim or action.
D. Relationship. Nothing contained in this Agreement shall be construed as creating any agency, partnership, or other form of joint enterprise between the parties.
E. Violation of Terms. Night Owl Publishing may revoke any domain name lease at its discretion upon finding a violation of the terms of the lease. Leasee will be entitled to a pro-rated amount of money based on the amount of time remaining on the lease.
F. Governing law. This Agreement, your rights and obligations and all actions contemplated by this Agreement shall be governed by the laws of the State of Mississippi, as if the Agreement was a contract wholly entered into and wholly performed within the State of Mississippi. Any action to enforce this Agreement or any matter relating to your use of the web site (including class actions or individual suits, regardless of whether or not a similar action and/or comparable remedy could be pursued in a foreign state) shall be brought exclusively in the Chancery Court in Jackson County, Mississippi, or if there is no jurisdiction in such court, then in the United States District Court for the Southern District of Mississippi in Gulfport.
